This upsurge in petitions for certiorari before final judgment is attributed to the rapid increase of district judges with liberal judicial philosophies issuing nationwide injunctions over the past two years, essentially blocking entire federal policies.
Bringing all three cases to the Supreme Court at once, Francisco added, will make sure that at least one of them will be a suitable case - known in Supreme Court parlance as a "vehicle" - in which to resolve the dispute.

"And absent this Court's prompt intervention, it is unlikely that the military will be able to implement its new policy any time soon", it said.

"Today, the US Department of Justice announced its intent to short-circuit established practice, asking the US Supreme Court to review a preliminary district court ruling before the 9th Circuit Court of Appeals has even had an opportunity to rule", said Mr Peter Renn, a lawyer with Lambda Legal, which represents the challengers in one of the cases Mr Francisco asked the Supreme Court to consider.
The Trump administration has taken an aggressive posture when lower courts have ruled against it on important issues. Diagnosed based on an individual's discomfort with their gendered appearance and identity as assigned at birth, that standard served for decades as the definitive metric of whether or not a person was permitted to receive transition resources like hormones and surgeries.
However, the subject matter seems to be without precedent, meaning it's ripe for a Supreme Court review.
