The Los Angeles District Attorney's office said on Tuesday it would not prosecute actor Kevin Spacey on a 1992 sexual assault accusation because it fell outside the California statute of limitations. "The allegation is outside the statute of limitations, therefore, an analysis of the strengths and weaknesses of the evidence is not warranted and prosecution is declined".
This particular allegation against Spacey involved an adult man who accused Spacey of sexually assaulting him in West Hollywood in October of 1992.
Prosecutors are reviewing a second case involving the House of Cards and American Beauty star that includes allegations he attacked a man in Malibu in October 2016.
Prosecutors, however, declined the case, noting the woman was 18 at the time and the statute of limitations for rape charges was six years at the time.
The Los Angeles Police Department began the investigation when a woman approached the LAPD and claimed she'd been assaulted by the Black-ish star, according to TMZ.

Beverly Hills police a year ago investigated Seagal after a woman reported he had raped her on January 1, 1993. The district attorney's office added that the case did not involve an underage victim. The victim was 18 years old at the time.
Earlier this year, Regina Simons, an extra who appeared in Seagal's 1994 film On Deadly Ground, accused Seagal of rape after numerous women came forward with accounts of sexual misconduct.
He apologized for any inappropriate conduct with Rapp but has not commented since and has stepped away from public life.
